In New York the dangerous or vicious propensity rule is typically proven when an animal has previously bitten another person but the Courts do note that prior bites are not the only evidence of vicious propensities. Also potentially relevant is whether the owner chose to restrain the dog, and the manner in which the dog was restrained.
