Probate and estate administration
When an individual passes away it is necessary to resolve their personal or financial affairs. The process of settling an estate is known as estate administration. In New York, if an individual dies with a valid will in place, that will must go through the probate process. This involves filing the will the appropriate Surrogates Court and having the estate judicially settled. The Court appoints an executor, a person who is legally responsible for settling the estate matters in accordance with the decedent's last wishes.
If there is not a will in place when an individual passes away, an administration proceeding is begun. The purpose of this proceeding is to appoint an administrator to settle the estate. The order of distribution is based on the relationship of each potential beneficiary to the decedent, and is governed by state intestacy laws.
